The act of professional negligence requires a professional relationship between a professional and a person claiming to have been injured by malpractice. For example, to sue a lawyer for malpractice, the person who carries the claim must have a lawyer-client relationship with the lawyer.

Typically, to succeed in malpractice actions the person making the malpractice claim must prove well that the professional is committing an act of negligence and that the person is injured as a result of a professional error.
